    That's true. But the offense probably wouldn't be punished as harshly. If it were up to me, I'd just make her pay a fine.

    I think it would be the severity of the offense. If someone just smuggles in a small amount of drugs for their boyfriends personal use, a fine is appropriate. However if it was a large amount for distribution / sales to the prisoners in general, that would merit a prison sentence.

    This isnt about weed, its about smuggling contraband into a correctional facility. All correctional facilities tell visitors in writing if you introduce anything not on the list into the institution you will be detained and arrested. There is no ambiguity and there is no exceptions
