Nowhere does it say the Senate shall consider a nominee nor does it say a hearing shall be granted nor does it say an up or down vote shall be taken. The Senate's Constitutional is advice and consent, nothing more, nothing less. When said advise and consent is given is irrelevant. Read the Constitution.

Regardless of whether I agree or disagree with it, it was The Biden Rule, referencing a 1992 speech by then-senator Joe Biden, a Democrat, arguing that if a Supreme Court seat became vacant during the summer, President Bush should wait until after the election to appoint a replacement, or else appoint a moderate acceptable to the then-Democratic Senate. I have said for years that when the D's come up with something clever, the R's frequently exponentially make it so much worse/better (depending on outlook).
