    Ohio’s Chief Justice Stands Up to Jeff Sessions in Support of Low-Income People. I did not read Sessions' conduct as supporting debtor's prisons, this issue has been a pet issue for me: unreasonable fines that effectively (or literally) imprison people who cannot pay same. Chief Justice O'Connor (who I had the pleasure of deposing when my client struck her vehicle from behind) reminded judges of their obligation to serve the public and promote fairness and equal treatment of rich and poor:

    “We have a special responsibility to act in a manner that bolsters public trust and confidence in the fair administration of justice for everyone. Practices that penalize the poor simply because of their economic state; that impose unreasonable fines, fees, or bail … upon on our citizens to raise money or cave to local funding pressure; or that create barriers to access to justice are simply wrong. No rescission of guidance by the [DOJ] changes that.”

    I was raised poor and my disabled mother used to tell us that there was no crime in being poor.

    The courts don't fuction for people who don't have money. It's a fraud.

    I respectfully disagree. In Ohio, I have seen judges, prosecutors, insurance adjusters and lawyers bend over backwards to help people b/c they are poor.

    I'm not really sure how one can say that when the inability to pay fines and the consequent punishments, the ability or inability to post bail, and actual due process and the quality of your representation, among other things, are all directly tied to your financial worth or lack thereof. While I know that there are members of the court that try and do their jobs fairly, overall, that is not the general reality.

    Well, in my experience and based on my observations, someone with money will be fined more than someone with no money. I have watched judges be more lenient b/c of poverty. I have seen judges be rougher on people with more assets. I can't speak to bail b/c I don't know. The quality of representation, I know many public defenders in Akron that are very good and passionate -- but overworked. Yes, if you have money you can afford a better lawyer but due process is met with the provision of a public defender. We've all done pro bono work to help the poor. It's not perfect but it's far from a situation that the courts 'don't function'.

    Not saying it is not the case but we need to separate a few things.

    1. Truly poor v/s terminally broke/stupid
    2. living beyond ones means v/s going into debt because of real needs
    3. $#@!ty stewardship v/s $#@!ty circumstances
