Bobbleheads: Should they be taxed? That's an actual Ohio Supreme Court case.

Bobbleheads?!?: Should they be taxed? That's an actual Ohio Supreme Court case. Should the Cincinnati Reds pay taxes on that Joey Votto bobblehead? The Ohio Supreme Court soon will decide the case of the bobbleheads – or the case of the players' cards, t-shirts and other Reds memorabilia, if you prefer those promotional products. Here is the dispute: Say the Reds play the Miami Marlins in a game that few fans wish to attend. To boost ticket sales, the Reds might offer a bobblehead or other memorabilia.

I hate to agree with the Taxman about pretty much anything, but I don't believe the Reds have much of a case here. Hard to say that you're reselling something when you're not receiving any remuneration whatsoever from the "buyer". If I am a season ticket holder, or if I've just purchased tickets to a certain number of games before the season starts (as many of us do), and then the team announces its promotional calendar, i.e., what bobbleheads or other items they're giving out on what days, I'm not billed any additional money for the tickets I've got that happen to be for games when they're giving something away. And if I buy a ticket for a game because they're giving away a bobblehead or other item that day, and they happen to cancel the promotion for some reason, I don't get any money back, nor do I have grounds for demanding a refund of the ticket price.

Personally, I think that Baseball teams should be considered religious organizations and that all their activities and revenue should be tax exempt, but that may be a minority view. I'll be attending services at Scottsdale Stadium this Tuesday because the Diamondbacks and Giants, in the spirit of ecumenical brotherhood, are giving away a dual-team bobblehead of St. Matt Williams.

I enjoyed watching St. Matt Williams play when he was a member of The Holy Indians.

Sounds to me like the Ohio Department of Taxation is hard up for revenue.

    Very good. I smiled. Broadly.
Call your state legislators and insist they approve the Article V convention of States to propose amendments.
