Except, in this case, it isn't.
The Constitution does not grant any legislative authority to the Executive nor to the judicial branch. Both have unconstitutionally usurped authority never granted.
If you are discussing the use of an EO to restrict immigration based on a Congressional law granting that flexibility to the President (which is what I believe you are doing), then we completely agree.
