    "A 5-6-year-old little girl was molested. Normally the sentence is state prison and then when you're released, you have to register as a sex offender," family attorney Ken Meleyco said.     "It is just appalling that somebody commits an offense like this and you have protections like 290 (failure to register as a sex offender) and Jessica’s Law and someone has the propensity to harm children and now nobody is warned," Davenport told The Stockton Record.

    According to Burgess' attorney, Gregory Davenport, the family is doing this with an agenda in mind.


    "I believe the allegations are motivated by greed," Davenport told The Stockton Record. "They are using this instance to try to gain financially.”



    The rape in question allegedly took place in 2016 when Burgess — a trusted family friend and someone who knew the dad for more than two decades — invited the family to his cabin in Calaveras County, The Sacramento Bee reported.

    "They trusted this man, he was a family friend, and he took advantage of them," Meleyco told KMOV-TV.

    Meleyco says the now 7-year-old is not doing very well. "She's showing all the symptoms of somebody who's been molested. She's in counseling, and she's gonna be in counseling all her life."

    The Stockton Record details the parents' testimony:



    I’m incredibly disgusted by his behavior and continuously disgusted by his lies,” she said before describing his sentence as “getting off so easy” and not registering as a sex offender.
    “I want other kids to be protected by possible future abuse by this man,” she said.
    The victim’s father, who has known Burgess for more than two decades, said: “I don’t have too many prized possessions in this world other than my family. (My daughter) will remember this the rest of her life. She sleeps on the floor outside our room."

    Sounds too weird. Maybe the case was really shaky? At any rate, yes lawsuit to follow. The lawyers comment "she'll be in counseling
    all of her life" has :Might as well have said" lawsuit to follow." That's not how tramua counseling works and certainly nothing you could predict at her age. In fact if she hasn't made some progress in 2 years . Find another counselor. Also what the hell do you mean "she sleeps on the floor outside your room" dad? Let her the hell in or work with her on sleeping in her own room.

    We have goofballs on this site that eat this up. I predict a multi-million dollar civil lawsuit to follow. It's payday boys! We found ourselves a pirate lawyer.

    It sure beats working.
    Call your state legislators and insist they approve the Article V convention of States to propose amendments.

    This may be a case where accusation= guilt and the old man took a deal the state offered because they had no proof.
    If a 79 year old molested a 5 year old there is some history with him , must be the state couldn't find any

    I agree, however in this case I think there are portions of the case that would explain a lot that would detract from media sensationalizing. I'm guessing a very low proof level with the old fella not wanting to go through a trial. But now he's ripe for suing.

    First of all a plea not admitting guilt was allowed for some reason other than just his money. Secondly has anyone researched to see what the actual incident comprised of and what related evidence there is?

    According to what I can find out "despite the word rape" there was no penetration. The case was launched by the girls mother who reports she saw the old geezer stick his hand down the little girls pants, a claim he disputes.
    Very weak case over blown to look like more than it is by your friendly neighborhood media. Also ,all parties, including the parents agreed to the charges.
    If the state had anything this would have been pushed and if they have any brains they looked at his past and couldn't find anything. I'm pretty sure most abusers don't start their "careers " at 77.
