The Court held that a social worker’s statutory duty to cooperate and share information with law enforcement with respect to child-abuse investigations does not render social worker an agent of law enforcement for purposes of Fifth and Sixth Amendments to United States Constitution when social worker interviews an alleged perpetrator unless other evidence demonstrates that social worker acted at direction or under control of law enforcement.

Anyone who is employed by local state or federal govt is an arm of the govt but that does not give them police powers, only statute gives police powers, I agree with this law

CPS acts like it is law enforcement. That is why I said in my previous post, lawyer up. If not, they will use your statements against you.

I do not. CPS are police without badges and weapons. This violates the spirit of the 4th Amendment.

Ok. Respectfully, I am not a lawyer. And I am familiar , familiar only with Miranda vs Arizona.

But the fifth amendment is the fifth amendment. CPS, Social Worker or Police Officer. Why would Miranda not apply to all?

Miranda applies to the police and Court officers like the DA. Social workers are neither.
