    Attorney Must Pay $103,000 After Flinging Hot Pasta During Restaurant Fight. That's a lot of dough?

    A Connecticut woman has been awarded more than $85,000 in her lawsuit claiming she was hit in the face with pasta in a spicy sauce flung by a lawyer during an argument with another man at a restaurant.

    Pasta in a spicy sauce, in the face, is worth 85,000 dollars?

    Was it hot, did, did it burn her? Did the spicy sauce cause irritation to her skin? Cause anaphylaxis?

    What is she claiming as actual damages? Humiliation... embarrassment?

    I wouldn't give her much on the pasta assault per se, but the guy who threw the plate of pasta in a restaurant full of people should be punished. He could have hit someone in the head with the plate. If the woman legitimately fell because of the pasta assault, then you take your plaintiffs as you find them. The fact that she had pre-existing conditions doesn't mitigate the defendant's actions. He just made her issues worse. That can be the difference between still being functional and totally disabled.

    Under tort law you take your victim as they are. So if you do something that would not normally be an issue, but harm someone extra because of their disability, you are screwed.

    Exactly. Unless you can prove that they are 'crumbling skull' i.e. that no matter what, they would have deteriorated and your actions either didn't change that or only slightly accelerated an inevitable process.
