Flynn was really screwed. The FBI played him, gained his trust, and got him to talk in non-interview sessions; Flynn thought they were working together. The fact that he wasn't under oath isn't that important. There is a crime to lie to the feds not under oath and another for under oath. But in this case it seems many FBI agents didn't think Flynn lied.
