    Judge drops suit of church that wants pot to be a sacrament

    INDIANAPOLIS (AP) — A judge has dismissed a lawsuit filed by a pot-smoking Indianapolis church that wants marijuana to be recognized as a sacrament.
    The Indianapolis Star reported that the 3-year-old case in Marion Circuit Court was dropped Friday.
    The First Church of Cannabis filed the lawsuit on grounds that pot was considered a sacrament under Indiana’s Religious Freedom Restoration Act.


    In her dismissal, Judge Sheryl Lynch said the church’s love for marijuana does not count as practicing a religion. She also said allowing exemptions for illegal marijuana use and possession would negatively impact society.
    The pro-cannabis church’s attorney told The Star last week he plans to appeal should the church lose the case. The group has argued that the government has no right to decide which religious beliefs should be protected.

    I think Churches should provide a choice wine, peyote or pot. Also since we were all created in GOD's image they should have strippers so we can admire the beauty of GOD's work.

    Booze, drugs and strippers Church membership would go through the roof.

    When I first heard the title, I thought it might be a Rastafarian church, since weed is sacred in that faith, however the First Church of Cannabis? The name of the church alone would get their case dismissed.

    I believe there was a Supreme Court decision years ago (like over 30) where Native-Americans were suing to be able to use peyote in religious ceremonies. I think the Supremes told them to basically take a hike but I could be wrong.

    No, peyote is accepted as a sacrament!

    You are correct, but there is a big BUT...

    Peyote was permitted for use in Indian religious practices by law in 1978. The law was challenged in the Supreme Court and Peyote was again outlawed because the Court determined that the law as written was vague and unenforceable. In 1994, Congress passed a new law that was more specifically written to address Indian religious practices. The law was amended in 1996 to specifically address the use of Peyote.

    As it stands today, the use of Peyote is legal for use in various Indian religious ceremonies. However, its use and possession is also strictly regulated and is not legal outside the parameters set by Congress.
