Yes, SCOTUS has made it clear that anyone on US soil has at least some Constitutional protections. I don't think there has been a case about illegals, but I can't see this Court denying an illegal the right to self defense.

It is a violation of federal law for an illegal alien to purchase or possess a firearm.

First off, he didn't have "permission" to possess a firearm to begin with.
That's a felony in NYC.
Second, he discharged a weapon in an unsafe manner
One doesn't discharge a firearm into the air. Bullets fall as fast as they go up.
Third, he is not a "citizen" of the US. He is an illegal alien.
He has a right to a status hearing and be deported, but that doesn't solve the problem. If this sets a precedence, all illegals without citizenship, can be armed.
Hell, they can just have border patrol issue .380's to all adults illegally entering our country.
What if they carry their own while entering this country, illegally? Do they get to keep them?
