Thread: Could the government be sued for mismanagement?

    Could the government be sued for mismanagement?

    Lets say for example that the government starts hatching SS and Medicare in a big way. Since those funds were earmarked for retirement not general fund and since the fund was clearly mismanaged at times and people have been charged their whole life with specific expectation offered. It is in fact a retirement insurance that has become a rock solid expectation and took money that could of been invested elsewhere out of people's pockets at knifepoint.
    Can they be sued by say AARP to hold up their end of the deal?

    No. The government can't be sued unless it allows it. Neither Social Security or Medicare is a contract with anyone.

    I think each and every person in the US Govt should be assessed for leadership ability, ability to deduce and deduct, thinking and reasoning assessment, and a temperament assessment should be done. See how well they know things outside their regular job and expertise. Personality and ego assessment should be done.

    The government is sovereign. When they take on a business stance they can be sued. When acting as a sovereign, you are out of luck- at least so far as lawsuits go. Think about it, if the government could be sued for sovereign actions we would need thousands of more lawyers and a lot more tax dollars to handle the lawsuits brought against the government.

    Well that explains why sometimes they can be sued and sometimes they can't. Thanks. So they can steal the money I've been forced to pay all my life earmarked for my retirement and have no recourse.
    Except of course a massive AARP one issue voting campaign.

    Past practice aside, SCOTUS has ruled it isn't a guarantee. Congress can end it tomorrow and that would be it. That the government took the money doesn't matter.
