The Diversity Immigrant Visa program is a United States congressionally mandated lottery program for receiving a United States Permanent Resident Card. It is also known as the Green Card Lottery. The lottery is administered on an annual basis by the Department of State and conducted under the terms of Section 203(c) of the Immigration and Nationality Act (INA). Section 131 of the Immigration Act of 1990 (Pub. L. 101-649) amended INA 203 to provide for a new class of immigrants known as "diversity immigrants" (DV immigrants). The Act makes available 55,000[1] permanent resident visas annually to natives of countries deemed to have low rates of immigration to the United States.

Distribution and lottery process

The visas are distributed on a regional basis, with each region sending fewer immigrants to the US in the previous 5 years receiving more diversity visas. Currently, Africa and Europe receive about 80% of the visas in the lottery.[5] In addition, no single country can receive more than 7% of the total number of visas (3,500).

In order to allow for those who do not pursue immigrant visas, and for the applicants who do not qualify, more 'winners' are selected in the lottery than there are visas available. Hence being selected from the lottery does not guarantee an immigrant visa to the U.S. To receive a diversity visa and immigrate to the United States, 'winners' must meet all eligibility requirements under U.S. law to qualify, and must be interviewed before the 50,000 green cards are distributed. Requirements include at least a high school diploma, or its equivalent, or two years of work experience in an occupation requiring at least two years training.

Over 13.6 million applications for the 2008 Diversity Visa Lottery (DV-2010) were submitted — an increase of 4.5 million, or 50%, from the 9.1 million applications submitted in the 2007 Diversity Visa Lottery (DV-2009).[6]

Starting with the DV-2008, several questions and options for answers have been added. Applicants are now required to provide information, such as the country where they currently live and their highest level of education achieved, in the Electronic Diversity Visa Entry Form (E-DV Entry Form). The open registration period for the lottery was restored from 60 days to 30 days beginning with the calendar year 2010 diversity visa lottery (DV-2012).

Legal status

In December 2005, the United States House of Representatives voted 273-148 to add an amendment to the border enforcement bill H.R. 4437 abolishing the DV. Opponents of the lottery said it was susceptible to fraud and was a way for terrorists to enter the country. The Senate never passed the bill.

Hesham Mohamed Hadayet, an immigrant from Egypt, a country not on the list of state sponsors of terrorism, was among the beneficiaries of the program.[9] 2007 GAO report stated: “In 2003, State’s Inspector General raised concerns that aliens from countries designated as state sponsors of terrorism can apply for diversity visas. Nearly 9,800 persons from these countries have obtained permanent residency in the United States through the program. We found no documented evidence that DV immigrants from these, or other, countries posed a terrorist or other threat.” [10] Immigrants coming to the United States in the other LPR visa categories are not restricted if they come from these same countries and ... background checks for national security risks are performed on all prospective immigrants seeking to come to the United States [11]

In March 2007, Congressman Bob Goodlatte (R-VA) introduced H.R. 1430, which would eliminate the diversity visa program. In June 2007, the U.S. House passed H.R. 2764 to eliminate funding for the program, and the Senate did likewise in September.[12] However, the final version of this bill with amendments, signed into law on December 26, 2007, did not include the removal of funds for the program. Several attempts have been made over the last several years to eliminate the lottery. Although H.R. 2764 was an appropriation bill and could only cut funds for the lottery during one fiscal year, this was the first time that both the House and the Senate passed a bill to halt the diversity visa program.H.R. 2764

Rep. Goodlatte reintroduced his Security and Fairness Enhancement for America Act (formerly H.R. 1430, now H.R. 2305) on May 7, 2009. The bill would have amended the Immigration and Nationality Act to eliminate the diversity immigrant program completely, but did not pass.

Rep. Sheila Jackson-Lee (D-TX) introduced the Save America Comprehensive Immigration Act of 2009 (H.R. 264) on January 7, 2009. The bill would have doubled the number of diversity visas available to 110,000 yearly. The bill did not pass.....snip~

Why aren't those Dems questioning that themselves. Then to top it off Congress doesnt stop the funding? Where is the money going if the program was slated to be stopped per the House and Senate passing the measure? I didn't read all that but lottery seems like the fairest system. You can't do background checks on people from countries that don't keep records. We don't know who these guys are so don't assume they are terrorists

Plus it was agreed upon by House and Senate to end the program. So why hasnt the funding stopped? Where is the Watchdog on this eh?

Visa Lottery Gave 28,783 to Those From State Sponsors of Terror, 2007-2016
November 13, 2017 | The U.S. government through its Visa Lottery program issued 28,783 visas to people from countries designated as "State Sponsors of Terrorism" between 2007 and 2016, according to the White House, based on data from the U.S. State Department.


“In the last decade, the U.S. issued nearly 30,000 permanent residence visas through the Visa Lottery to randomly selected nationals from countries designated as "State Sponsors of Terrorism" by the State Department," said the White House in a Nov. 13 email. "This does not include the additional tens of thousands of foreign nationals admitted from these countries through other immigration categories (such as family-based immigration, as well as asylee, refugee, and others).” The three state sponsors of terrorism were Iran, Sudan and Syria. According to the data, the number of visas from those countries increased substantially under the two Obama administrations. For instance, in 2008, the last full year of the George W. Bush administration, 841 lottery visas were granted to Iran; in 2016, the last full year of the Obama administration, 2,788 lottery visas were selected from Iran. Syria got 40 lottery visas in 2008 and 164 lottery visas in 2016.

The suspect in the Oct. 31, 2017 Islamic terrorism attack in New York City is Sayfullo Saipov, who entered the United States through the Visa Lottery program. In the Oct. 31 attack, using a rented truck as a weapon, 8 people were killed and 12 were injured. The White House email states, "President Trump has called on Congress to eliminate the Visa Lottery and end Chain Migration.... [T]hese policies endanger national security, strain federal resources, and imperil the economic security of vulnerable American workers." "Every single year, through a computer-generated random drawing, the Visa Lottery selects 50,000 foreign nationals to apply for permanent residence in the United States and get Green Cards," states the email. "Many of them have absolutely no ties to the United States, no special skills, and limited education. "The Visa Lottery program was championed by Ted Kennedy in 1990 and co-sponsored by Chuck Schumer. In a May 2006 floor speech, Schumer praised what he called 'an excellent program' and urged his colleagues to keep it in operation. 'My city of New York has dramatically benefited from this program,' Schumer said, 'So I plead with my colleagues, keep the diversity visa program.'"

With chain migration, a lottery visa immigrant can sponsor his or her family members to come live in the United States. A recent report by the Center for Immigration Studies (CIS) showed that for every one lottery immigrant, an additional 3.45 family members, on average, were sponsored (chain migration). From its analysis, CIS said that between 1994 and 2016, there were 1,102,373 diversity lottery visa immigrants and an average estimated 3,803,187 chain migrants. "Family-based immigration has accounted for more than 60% of new immigration to the U.S. over the last 35 years—or roughly 20 million new foreign nationals," stated the White House email. "As Green Card holders, these foreign nationals have a pathway to U.S. citizenship, which allows them to vote in U.S. elections and access federal benefits paid for by U.S. taxpayers." President Trump wants to replace the visa lottery and chain migration with a merit-based immigration system.

As explained by Attorney General Jeff Sessions, “The president’s immigration plan would switch us to a merit-based immigration system. He would abolish the Diversity Visa Lottery and replace it with a points-based system like is used in Canada and Australia. This is the best way to ensure that the immigration system in America is benefitting America. We don’t use random chance in college admissions and we don’t roll a die to hire people." "By the same token, a lottery tells us nothing about who would thrive in this country," said Sessions. "This merit-based system would be a boon to our economy and raise wages. But it is not just an issue of economic security; it is an issue of national security. A merit-based system, by definition, would be safer than a lottery or even extended family-based immigration." "The president’s plan is essential to protecting our national security, while also banning drunk drivers, fraudsters, gang members, and child abusers," said the attorney general. "It’s time to end the Diversity Lottery in favor of a rational, merit-based system.”

November 14, 2017 - A total of six foreign nationals with suspected terror ties immigrated to the U.S. through the visa lottery, including the man charged with driving a truck into pedestrians and bicyclists in New York City on Halloween, the Trump administration said Tuesday.


Sayfullo Saipov, who immigrated from Uzbekistan and pledged his allegiance to ISIS, was the most recent foreign national with suspected ties to terrorism. Five other foreign nationals also entered the U.S. through the visa lottery program. Four days before Saipov’s deadly attack, Abdurasul Hasanovich Juraboev, who also hails from Uzbekistan, was sentenced to 15 years in prison on Oct. 27, after pleading guilty to conspiring to provide material support to Islamic State terrorists. The government is planning to send Juraboev back to Uzbekistan once he’s finished serving his sentence.

According to the Justice Department, “Juraboev posted a threat on an Uzbek-language website to kill President Obama in an act of martyrdom on behalf of ISIS.” He told federal agents he believed in ISIS’s agenda, including the establishment of an Islamic caliphate in Iraq and Syria by force. He said he wanted to travel to Syria to fight on behalf of ISIS, but he didn’t have the means to travel. He also said that if he was not able to travel, “he would engage in an act of martyrdom on U.S. soil if ordered to do so by ISIS, such as killing the President or planting a bomb on Coney Island.”

In 2009, Pakistani national, Syed Haris Ahmed, was convicted of terrorism related activities in the United States and abroad. Ahmed entered the U.S. as a Visa Lottery winner. Another foreign national with suspected terror ties, Egyptian national Hesham Mohamed Ali Hedayet opened fire at the El Al Airlines ticket counter at LAX airport in July 2002, killing two ticket agents and wounding three others. He first arrived in the U.S. in 1992 and obtained his lawful permanent resident status through his wife, who was randomly selected as a visa lottery winner in 1997.

Also in 2002, Pakistani national Imran Mandhai pled guilty in August to conspiring to bomb a National Guard Armory and electrical power substations near Miami. Mandhai immigrated to the U.S. through his parents, who were visa lottery winners. And in 1997, Mousa Mohammed Abu Marzook, a U.S. Hamas leader, was deported for terrorist activities. Marzook received a Green Card through the predecessor program to the Visa Lottery.
