When they take the House, Senate, and the WH, Democrats plan to expand the Supreme Court from 9 to 11 justices. This will allow them to appoint two more liberal judges. Some reports claim they will add more than that!

Isn't it really thanks to Dirty-Harry and his abandonment of the filibuster for appointment of judges? Just remember, the R's have a long history (loooooooonnnnngggg) of taking what the D's do, making it better and sticking it up the D's Pelosi. In other words, paybacks are a Pelosi.

It would be terrible if that caused some unhinged person to "take out" excess Justices.

It's unlikely they'll overturn the Judiciary Act of 1789, but...keep hope alive.

The Judiciary Act set the SCOTUS justices at 6. We now have 9.

The Judiciary Act of 1789 established the first Supreme Court, with six Justices. In 1801, President John Adams and a lame-duck Federalist Congress passed the Judiciary Act of 1801, which reduced the Court to five Justices in an attempt to limit incoming President Thomas Jefferson’s appointments. Jefferson and his Democratic-Republicans soon repealed that act, putting the Court back to six Justices. Then, in 1807, Jefferson and Congress added a seventh Justice when Congress added a seventh federal court circuit.

In early 1837, President Andrew Jackson was able to add two additional Justices after Congress expanded the number of federal circuit court districts. Under different circumstances, Congress created
the 10th Circuit in 1863 during the Civil War, and the Court briefly had 10 Justices. Congress then passed legislation in 1866 to reduce the Court to seven Justices. That only lasted until 1869, when a new Judiciary Act sponsored by Senator Lyman Trumbull put the number back to nine Justices, with six required at a sitting to form a quorum. (President Ulysses S. Grant eventually signed that legislation and nominated William Strong and Joseph Bradley to the newly restored seats.)

Since then, aside from President Franklin Roosevelt’s ill-fated threat in 1937 to add new Justices who sympathized with his policies to the Supreme Court, the number of Justices on the Court has remained stable.

Oh bullshit they were wanting to do that anyway. They don't play by the rules and all they are is about power. Screw them Cocaine Mitch will push through the nominee. BTW you assume they are going to win. Hell.. What if Republicans win all the chambers and POTUS. Maybe then they can reach bipartisan concensus that court needs expaned to 11 and nominate two more to court.

That would be good idea, but the real problem is that this country has allowed politics to insidiously take a seat in the room. Our constitution is thereby being watered down to political interpretation rather than the neutral ideal it laid down.

I say 5 of each side and no kicking the can down the road.

Leave it alone. It is all cyclical. The next Prez will get 3 or 4. I would like to see them have an agreement to put the filibuster back in for judges.

I don't think a judge filibustering anything is a good idea. Our Supreme Court has become pretty much a rubber stamp for political expediency. A neutral court should be a requirement.

Thinking about this a little bit. The seat really is a side issue to the issue of court packing. Court packing is a no-go zone. Its banana republic and will instantly destroy the legitimacy of the Judicial Branch and yes, it absolutely could mean the end of the country. I would suggest the Republicans should probably confirm the seat and make continuing the union dependent on an amendment prohibiting court packing. Court packing is a constitutional Rubicon. The pick alone has importance in a context, the context of a nine member court. However, the specter of court packing was raised pre-Ginsburg and is now being affirmatively threatened post-Ginsburg. Whether or not a post-Democratic victory results in the Democrats packing the court remains to be seen, but the Sword of Damocles is now hanging over the entire concept of judicial independence. Of course all of this on the basis that the Republicans blocked a hearing for Garland who the Democrats would have to admit the Republicans weren’t going to confirm anyway. Garland wasn't 'owed' a seat. They can say that denying a hearing wasn’t fair, but the resulting threat is so clearly beyond the pale that they are threatening an overtly political court. At this point, honestly, can we trust the Democrats NOT to pack the court even if they don’t confirm somebody? The issue now is really court packing. Its about whether or not the Democrats will tolerate losing and they make it clear they won’t. Even if you're a Democrat you should have the foresight to understand that at some point in the future there will be a Republican President and a Republican controlled Senate and that constitutional tandem will ALSO pack the court. The result: A FUCKING ABSURDITY. DRAW A LINE right here, right now.
