Private prisons play a part in the over criminalization of America, but the desire to subsidize cops, judges, lawyers, prosecutors and others in the system is the main culprit. They financially prey on the population
If they play a part it's a nominal one but I'm skeptical. There doesn't appear to be any evidence that this is true. The proportion of inmates in private prisons has actually declined and states with a relatively large number of private prisons do not show the increase in prison population you'd expect if this were true.

The public wants the laws to protect society.
The legislature enacts the laws.
SCOTUS said that due process required that the accused was entitled to counsel - they must be paid.
Then they were costing too much.
Prisons cost a lot.
The lawyers doing criminal defense work are largely over-worked and underpaid.
The judges are slammed with criminal drug cases.
If we let everybody out and had no criminal justice system, they'd be crying 'Where's the lawyers, judges, prosecutors and prisons - we need them'

The only issue the cited article presents is inadequate security. I'm not sure if that's accurate or not but the actual stats contradict the idea that private prisons drive "mass incarceration". I'm not sure what it is but prison myths have a powerful attraction to certain types of people. They just can't let them go.
