What did he do that was unethical? Its my understanding that since Flynn plead guilty that this case was a done deal and that then to rescind it requires the judge to agree. Its not just a matter of the JD saying Flynn gets off the hook. Am I wrong about that? I don't know.

it is the State of New York. they have a history of trying to "get" Trump..like CA, a great many of their cases get dismissed once it get's a "real" court that is impartial. The 4th district court is the hacks favorite go to court

Well, were it not for the fact that Sullivan is in DC and the mandamus petition was filed in the DC Circuit (and the 4th Circuit is in Richmond), these would be excellent points.

Some things during the process which has already been discussed. What I am thinking about here is the allowance for an amicus brief to argue that the DoJ can't drop the case. There is no provision for such a thing at the trial level (Federal Rules of Criminal Procedure.) There are at the appellate level. He should be dropping the case based on the DoJ's motion.

A criminal trail court judge is suppose to protect the defendant from government abuse, not actively work against the defendant.
