    He would be smart then to fight it and then get it thrown out on appeal. I don't think anyone was calling this event premeditated so 1 and 2 are out. Overcharging is a mistake. It only takes 1 juror and then you have nothing.
    If he gets the max then he will appeal and it will be reduced in a couple of years.

    They have not overcharged him and there needs to to be grounds for an appeal. It’s not automatic as in death penalty cases.

    Right. You may use a knee between the shoulder blades while cuffing the perp, but once he is cuffed there is no reason to stay in that position.
