While I agree with you in basis, and I'm most definitely an animal defender, a person would have to commit those acts upon the violator.

I believe someone who has intentionally harmed an animal should be strapped down on top of a month old bag of garbage, and left out in the wilds of Montana. Let Nature take it's course.

There would be no shortage of people to commit those acts upon the violator.

Just put up a flyer in the PETA HQ building.

Some States and jurisdictions might even let him get away with suing you for the injury he sustained at the hands of your dog. Is it right? I guess that depends on perspective.
In the case you cite, I could probably shoot the burglar -- because burglary, by definition, is already a felony. If, however, a passerby trespassed on my property and my dog attacked, that person might be awarded damages -- if I was negligent in keeping the dog (known vicious dog) or if the passerby was deemed to be less than 50% responsible for the dog attack.

You[re probably right that the intent of killing the dog would have to be malicious -- but that's how the OP framed the issue. Malicious intent.

    Those PETA folks aren't sane.

Private Pickel: There are Federal animal cruelty laws...
If God was hungry, He would not tell man, Psalm 50, as he looks for excuses. Laws do not equally protect all animal species. USDA's wildlife services has destroyed millions of America's wild animals, taken the balance of nature apart.

Wildlife Services of the U.S. Department of Agriculture (USDA) has run a federal wildlife-killing program. Wildlife Services has contracted with federal, state and county agencies, and private landowners to kill wildlife. In many cases, the agency kills animals, as producers of agricultural animals expand grazing areas deeper and deeper into the natural habitats of native species like coyotes, bobcats, and foxes.

When I was a kid my friends and I used to hunt kangaroos with dogs. Mostly staghounds but other kinds too - one of my friends had a rottweiler that he would take. There isn't a lot in the world that is more brutal thana rottweiler ripping a kangaroo apart. I don't agree with that kind of thing now and its highly illegal too even though people still do it - but in the moment you can get a bloodlust or something and you can enjoy the kill. A lot of people still use dogs for hunting pigs but with a pig its less brutal because usually the pig is finished off with a knife. With kangaroos once the dogs have the better of it a dog will tear the kangaroos throat out - but sometimes that can take a while - a large roo can put up a decent fight most if the time.

I figure if you abuse an animal you yourself should be subject to the exact same sort of abuse.
