I do not get how that cannot be obvious at the time. I do get how a woman might struggle with whether to report immediately or not. That should not be held against her but the difficulty with evidence caused by the delay should also not be held against him. Personally in the absense of a weapon or physical violence I believe true rape would not be easy and should produce evidence.
