    Exonerated after nearly 5 years, a man sues Hertz over alibi documents...

    After being locked up for nearly five years for a crime he did not commit, a Michigan man was exonerated in 2020. Herbert Alford, 47, served 1,700 days in prison after being falsely convicted in the murder of Michael Adams in 2016. Alford received a 30 to 60 year sentence. Alford is now suing the Hertz rental car company because they refused to turn over a receipt that corroborated his alibi.

    It was a difficult path to freedom because it took several years, multiple court orders and subpoenas before Hertz turned over the receipt.

    The receipt shows that Alford used his credit card at the Lansing Airport’s Hertz location at 3 p.m. on October 18, 2011. The timestamp on the receipt is six minutes before Adams was shot and killed in the 3400 block of Pleasant Grove Road at 2:54 p.m.

    I find Jamie White's attempt to make it racial is pathetic. Of course if White is the original lawyer it's understandable he's trying to cover up his incompetence.

    I don't understand the incompetence of the attorney here. The attorney has the power of subpoena. The attorney dropped the ball here.

    To say nothing of the investigators, and prosecutor's office. You would think they would want to get the right person for the crime. This just goes to show, often times prosecutors care more about convictions, than justice

    Detective gets a promotion. Prosecutor gets rid of another case.

    It's the main reason I am against the death penalty and I am not know as a soft guy.

    Something doesn’t add up here, since he was sentenced to 30-60 years, I’m assuming there was a trial. So, in all the pre-trial procedures, not to mention the investigation, nobody saw fit to corroborate the alibi of the accused? I’ve rented many cars, and when using credit cards the authorization hits your account as soon as the card is swiped. The credit card company couldn’t produce this document? I wonder what evidence the investigators and prosecutor had that was overwhelming enough that a simple invoice was enough to prove he didn’t commit the murder.

    I mean,

    Me: “your honor, I could not have committed this crime because I was at the rental car company when the crime was committed, but the company will not turn over the receipt to corroborate my story.”

    Judge: “issue a subpoena for the receipt”...receipt received...

    Judge: “case dismissed with prejudice”

    I'd like to see a timeline showing when Hertz was first asked to produce the receipt, how they responded - the news story says that they "refused" - and what steps the defense attorney took to obtain it and when he did so. All that (and more) would be necessary to any determination of who was at fault and in what proportion. I can't conceive of any competent criminal attorney not going after that record - assuming that he knew it existed - tooth and nail from Day One.
