MN Supreme Court Overturns Rape Conviction Because the Woman Willingly Drank Alcohol

The Minnesota Supreme Court overturned the conviction of a man who picked up a woman outside a bar, took her home, and had sex with her. Under state law, since the woman drank the alcohol willingly, the man could not be charged with 3rd-degree criminal sexual misconduct.

The judges said the man could be charged with a gross misdemeanor — 5th-degree sexual conduct. The difference is that the 3rd-degree assault charge carries a sentence of 15 years in prison while the misdemeanor would put the man in jail for 1 year.

Naturally, many women are outraged at the Minnesota Supreme Court.

In this case, the judge’s hands had been tied by the state legislature who wrote this $#@!amamie statute. The judges interpreted the law correctly so if you’re going to rant against anyone, state lawmakers should be the target.

Here's a good judge. We may not agree with his decision, but he's right. Blame the legislature.
Another judge who follows the law instead of reinventing it.

Minnesota is woke these days. I suspect the legislature will be re-writing its sex offenses laws.

An intoxicated person in Ohio cannot legally consent.

Those laws are typically applied one-sided, in the female's favor.

We had a case at one of Ohio's public universities where the young man was charged and expelled - accused of sexual assault. The evidence was that they were both equally drunk.

We won. Criminal charges dismissed. Student reinstated. IIRC.
