    South Dakota Gov. Kristi Noem Vetoes Bill to Protect Women's Sports and Ban Trans Ath

    Gov. Noem vetoed a bill that would not allow men who think they are girls play in women's sports. She vetoed it because the state budget can't support defending a lawsuit.

    She did appear on the Dan Bongino Show, last Friday I think, to defend herself. Dan didn't buy it, but didn't beat her up over it.


    South Dakota Gov. Kristi Noem Vetoes Bill to Protect Women's Sports and Ban Trans Athletes

    South Dakota Gov. Kristi Noem (R) on Monday vetoed a bill that would bar trans athletes from participating in women's sports, something that is overwhelmingly popular in the state. Noem previously sent back the bill to the state legislature, under the "Style and Form" revision process. According to the governor, "legal scholars" have warned her about the potential lawsuits associated with the bill, especially when it comes to the National Collegiate Athletic Association (NCAA) and their demands. Instead, she wanted to form a coalition to take on those who file litigation against South Dakota, something that would be a strain on the state's small budget.


    The news comes after the legislature voted 67-2 to reject Noem's "Style and Form" veto. Noem had the ability to sign the bill, as is, into law, or veto it. The governor vetoed the bill and instead issued two executive orders, aimed at protecting K-12 athletics and collegiate athletics.


    In a thread on Twitter, Noem said she plans to call a special session on this issue, as well as medical marijuana and the latest COVID relief package.

    We'll see how this affects her long term. A lot will depend on what she does with her commission to study the issue. Perhaps she is buying time to see if she can get some conservative organizations to help with future litigation expenses.

    Noem said she was excited to sign the bill, passed by the state Legislature to ensure that biological men are not allowed to compete in women’s sports. But then, she backtracked, issuing a style-and-form veto, requesting that the Legislature rewrite parts of the bill. Noem has a few issues with the bill, including tightening up some of the legal language to prevent the state from being sued for schools that violate the protections, but her chief complaint was that, by including college athletics, the state would run afoul of the NCAA.


    Noem said she didn’t want to fight a losing battle against the NCAA but that she hoped that the coalition of states moving to protect women’s sports would become so large that the NCAA “cannot possibly punish us all.” But Noem abandoned that coalition before it could even set its feet, leaving other red states out to dry.


    So Noem backed away from the same bill she planned to sign, worried that the NCAA would blacklist South Dakota despite not having moved against states passing these bills, calling for a coalition that she doesn’t want to join until it’s clear it can win. Not exactly ideal for someone who ostensibly has national aspirations......snip~

    Conservatives are pushing back on Noem’s lack of commitment, and rightfully so. States can’t adequately protect women’s sports if one of the nation’s most prominent GOP governors shows she doesn’t have the stomach for a fight that hasn’t even materialized yet. It’s a black mark on the resume of a rising GOP star, and it will loom large once the presidential cycle kicks into gear......snip~
