    I see the consideration of his prior burglary convictions because that is often connected to drug use. It costs money to pay for expensive habits and crime is often the result. Not just so called harmless personal drug use as claimed by libertarians and progressives alike.

    That said I agree this is too harsh. I would not count Pot possession as a third strike offense.

    The death penalty has been carried out for crimes that today would not be so proscribed, such as rape. In the early 20th century China solved its drug addiction problem by executing anyone caught using drugs a second time. What if spitting on the sidewalk was a known vector for the spread of Covid and one spitter could infect 1000's of people. Would the death penalty for the spitter then be appropriate?

    I would suspect a legislature could mandate any penalty it wished. It would then become a potential 8th Amendment issue
