If someone has a gun on you and you think he is going to use it, then using the element of surprise might only reduce your life by a few minutes or less.
This is where I had the only issue with the Arbery case. I don't know if he really had no way out, No he was no obligated to run, but did he charge a person holding the gun out of rage, stupidity, despair...?
Nothing in that trial gave me an indication as to why he would have decided to charge McMichael. Then we have to figure out what he would have done once he got the fun, since he already had another gun out and ready to shoot him had he taken the gun and tried to use it for protection.
If he broke into my house and I pulled my gun, then he came after my gun then I'm shooting in self defense. As Arbery, if he is convinced he is being chased by a lynch mob and he has no way out but to grab the weapon, then he is just acting in self-defense.
The entire actions of the three chasing a trespasser down the street with trucks and guns should be a totally different set of charges, even had this turned out with an arrest or Arbery getting away.
