Well it's actually a list of the things the union can do. Everything not on the "can do" list is prohibited.

I have said many times that Article 1, sec. 8 is the list of powers the states ceded to the federal government.

The Constitution doesn't micro manage how they do it, although that is why it is important to have serious judges who do not think the Constitution is a living document.
