    The teacher makes a good point...she doesn't want to be put in a position of lying to the parents.



    Ricard has two transgender students in her class, the judge wrote, neither of whom have authorized the district to disclose their preferred names and pronouns to their parents. While Ricard uses their preferred names in class and avoids pronouns, she has emailed parents using a student's legal name and biological pronouns.
    "Plaintiff believes that addressing students one way at school and a different way when speaking to their parents is dishonest," the opinion states. "Being dishonest violates her sincere religious beliefs."

    Interesting case. I agree that teachers should not be put in the position of lying to parents.

    The article quotes Will Rapp, a statewide organizer for the Kansas chapter of GLSEN:

    "When transgender and nonbinary youth feel unsafe at school, they experience negative impacts not only to their health, but to their academic achievement and likelihood of graduating or moving to higher education opportunities."Attempts to forcibly out students also jeopardize educators’ ability to foster trust and create the kind of safe school environment that allows young people to grow and learn without fear of harassment or discrimination."

    I don't see what preferred gender pronouns do to protect transgender and nonbinary kids from harassment or increase their safety at school. Quite possibly they accomplish the opposite.

    However, at this point the Court has only issued a temporary injunction that will delay disciplining Ricard, if she were to intentionally disclose a student’s "preferred name or pronoun" to a parent until May 22, 2022, when her contract runs out and she takes formal retirement. Ricard is seeking a permanent injunction and damages and the judge did not rule on the merits of the case. She may have a problem because the school is apparently following Federal FERPA Guidance in respect of not disclosing preferred name and pronoun information to parents unless the student requests the administration or counselor to do so.     The federal law regarding non-discrimination in employment on the basis of religion has one exemption, that being the placing of 'undue burden' on the employer. So it will be interesting to see how the case is ultimately decided.

    "Sincere religious beliefs" should not be a bullet-proof, get-out-of-trouble-free card for every instance of violating a law or policy. The teacher's claim that using different names in class and in communicating with parents by email made her feel that she was "lying to the parents" is thin at best. What other school policies would her claimed "religious beliefs" compel her to violate? Her actions are transparently born from a disapproval of transgendered individuals, and to pretend otherwise is dishonest.

    What's dishonest is a school trying to hide this from parents. The teacher's position that she is lying to parents is not at all thin.
