    This is a good judicial approach that is also practiced with unpublished scientific papers under review. Let your critics see the work and point out flaws that possibly need revision before you go forward. Maybe someone even changes their mind but not always.

    Right. Drafts of the opinion, dissent, and concurrence are shared. Views can change, but here it seems the changes in the draft opinion were to respond to relevant arguments of the dissent and concurrence. The opinion detailed why J. Thomas's views about other issues like gay and interracial marriage isn't affected by the reasoning of the opinion.
