    Malfeasance on the part of the government isn't the issue here. If Zuckerberg believed what he was being told was the truth and opted to censor what he believed to be Russian disinformation, he or his company did not do anything they were not allowed to do.

    The government is not allowed to recruit private agents to suppress free speech. So, that's a yes, got it.

    It doesn't matter.

    HB 20 suppresses not speech but censorship. Zuck can still render his opinion, but can no longer censor the opinions of others. This enhances our right to speak.

    Yes, Texas is once again trying to push the constitutional envelope, however the internet is Federal jurisdiction and is regulated by Federal laws. Secondly and probably even more importantly, social media platforms are private property. They are not the equivalent of a public square, which by definition stands on publicly owned ground, regardless if that's how people are using them. Thirdly, the 1st Amendment prohibitions on infringing free speech apply to government, not private enterprise. You can't go to work and say anything you want or distribute political propaganda to all your fellow employees without the owner of that business having some say over whether it is permitted speech. You can't go to a restaurant and use foul language in your interactions with the servers and other patrons and then try to rely on your 1st Amendment rights when you are asked to leave. They simply wouldn't apply.

    This law will ultimately be reviewed by SCOTUS for constitutionality.
