I think he should be punished by the NFL but not charged. Why? Because it was minor and he was inside his arena - and the photographer assumed the risk of such things. It is a civil matter, not a criminal matter.

He got to play in the Pro Bowl before being arrested and his lawyers only show up in court to be be granted delays. He now won't go to trial until after this season is over.
Kinda like the Dick Cheny shooting a guy in the face and telling the cops when he'd meet with them.
