    Winners don't go into any match/competition/case planning to lose. I seriously would not have an attorney who publicly predicted I was going to lose. But, it doesn't look as though Trump's attorneys really did that. That's just Rolling Stone's bias showing.
    In jury selection generally (I am not looking up NY specific law) each side gets two pre-emptive cuts to the jury pool- any reason, so long as it isn't race or sex. Probably gender too now. Any other challenges are for cause. Do you think a judge in NYC is going to grant a motion to strike a potential juror because they are a democrat? How much bias would a juror display during voir dire? (I'll hand you the stupid ones will).

    Attorneys should have a winning attitude. But attorneys also have to advise their clients of risks. Skipping that part opens you up to a malpractice lawsuit in civil cases and both malpractice and ineffective assistance of counsel (an appellate issue) in criminal cases. For both civil and criminal cases an attorney also has to worry about his bar associations ethics board if he skips the risk part.

    Facts are what they are. I've been trying cases for nearly 36 years. I've won cases I should've lost and lost cases I should've won. You don't plan to lose but you know what the facts are going in b/c you've taken depositions beforehand. You go in trying to mitigate losses - or in a criminal case, set it up for appeal. I've watched people I've beat crying and screaming at their lawyers after being told they were going to win - and they didn't.

    It is another reason to. It only takes us tipping another 60,000 votes in the right places and Trump won last time.

    But that is how Democrats win by assembling groups of single issue voters.
